Landmark Debt Restructuring Transaction in the Hospitality Sector

Your Legal Partners advised HIG Capital in connection with one of the most significant restructuring transactions in the Greek market in recent years — the conclusion of ratified the rehabilitation agreement of the Kipriotis Group that was recently ratified by the court, pursuant to which five hotel units on the island of Kos are transferred to Kos Holdings S.A., the investment vehicle of HIG Capital, while €140 million in non-performing loans are settled, thereby ensuring the continuation of the hotels’ business operations as a going concern.
This landmark transaction results in the creation of a strong platform for the upgrading and repositioning of the five hotel complexes, contributing to the broader tourism ecosystem of Kos and the Dodecanese.
Acting as legal advisors to HIG throughout this demanding and multi-faceted restructuring process required sustained and intensive negotiation rounds across all stakeholders, spanning multiple phases and involving the careful structuring and negotiation of the rehabilitation agreement itself. The seamless collaboration between our practice groups and other advisors was central to navigating the legal, commercial, and regulatory intricacies of this process and ultimately delivering a successful, court-ratified outcome.
